Not everyone who is convicted of drink driving offences including failing to provide specimens gets imprisonment - most receive a fine or similar - so why has he been sent to prison ? Has he a history and is a repeat offender ? Unless there are some other related circumstances the facts would suggest he is. On the day he was stopped / asked to provide specimens it was not as a result of him being involved in a serious collision that caused injury to others so my guess is he has fairly recent similar offences against him. Perhaps he was disqualified from driving when he was stopped but the press reports don't suggest this. Alternatively he may have seriously gone out of his way to piss the court off and generate a reaction against him. |

Claiming to have had just one pint then his solicitor suggesting it could have been a mix up taking drink together with prescribed drugs wont get him anywhere.
The simple 'get out' was to provide a roadside sample. Nobody will ever know now what he had consumed - I have known people have a pint or two provide a roadside specimen - in reality being under the limit is your only get out - those who point blank refuse to provide anything like a relative of mine probably know in their hears they are so pissed it would look even worse if their true readings were discovered. And going off the press article - the one offence you cannot delay procedure wise is drink related driving because you want to chat about it with your solicitor (if and when he / she can be located). I go back to my earlier message - there are plenty of people in Saunders position ending up in court for refusal to provide specimens of breath - it's very unusual to say the least for them to be sent to prison without any aggravating circumstances - the outcome of the appeal will be interesting and so will the grounds offered by his legal rep. |

Well more often than not I've defended him on here, but that's shocking behaviour and utterly indefensible. He should be ashamed of what he did and he and his legal team should be even more ashamed that they are trying to worm their way out of it. I hope the appeal backfires and gets even more bird. Disgusting.

I believe the appeal is not against conviction purely based on the sentence - i.e. being sent to prison. The Court and CPS might be deliberately going out of their way to use his case as a high profile celebrity publicity warning to others. With the bodycam video footage there is unlikely to be a better example. |
