I believe the appeal is not against conviction purely based on the sentence - i.e. being sent to prison.

The Court and CPS might be deliberately going out of their way to use his case as a high profile celebrity publicity warning to others. With the bodycam video footage there is unlikely to be a better example.

Lots do - play the system for as long as possible and change your plea last minute - but in reality he's up the creek without a paddle - it's so cut and dry - he had two options - provide breath samples or don't - he made the wrong selection but it's all irrelevant now.

The appeal all comes down to one issue - severity of sentence - should he go to prison for 10 weeks ? what are the sentencing guidelines at Magistrates Court for simple non aggravated failure or refusal to provide breath samples - why has he been sentenced to prison whilst many others in a similar position do not.

So it might well boil down to this.

Not everyone who is convicted of drink driving offences including failing to provide specimens gets imprisonment - most receive a fine or similar - so why has he been sent to prison ? Has he a history and is a repeat offender ? Unless there are some other related circumstances the facts would suggest he is. On the day he was stopped / asked to provide specimens it was not as a result of him being involved in a serious collision that caused injury to others so my guess is he has fairly recent similar offences against him. Perhaps he was disqualified from driving when he was stopped but the press reports don't suggest this. Alternatively he may have seriously gone out of his way to piss the court off and generate a reaction against him.
