FC boss Alex Hamilton was last night seeking leave to appeal a High Court
judgment over who owns the Racecourse.
The contested ruling vested freehold of the Racecourse in the League Two club,
not Hamilton's company.
Yesterday, the property developer's legal team contacted club administrator
David Acland with news of the planned legal action, dashing hopes of a speedy
end to the long-running saga.
At the High Court in Birmingham last Thursday, Justice Norris ruled as improper
the land transaction by which Mr Hamilton's company, Crucialmove, acquired the
freehold of the stadium.
He also denied Hamilton permission to appeal his judgment.
Instead, Hamilton's legal team will now petition the Court of Appeal in London
for leave to take the case before a panel of top judges.
The petition outlining the grounds of the appeal will be considered by a single
senior member of the court who will either uphold Judge Norris's ruling or grant
Hamilton's request to go to full trial.
Mr Acland, who this week revealed he was talking to parties interested in buying
the club - with the aim of taking it out of administration - said his work would
continue pending the court moves.
